Nannies on Demand Terms & Conditions Contract for nanny & babysitting services


1.      This Terms & Conditions Contract is between Nannies on Demand and the Client.  A Client is defined as a person(s) who approaches Nannies on Demand either via verbal or written instruction and requests Nannies on Demand to introduce the Client to a Nanny, Maternity Nurse, Mother’s Help (or any other childcare professional requested), herein after to be called the ‘Candidate,’ for the purpose of employment.

2.      By registering with Nannies on Demand either verbally or through written instruction the Client accepts and wholly understands Nannies on Demand’s Terms & Conditions of Business.  Any and all business undertaken by Nannies on Demand is transacted subject to the conditions herein set out, each of which shall be incorporated and implied by any agreement with Nannies on Demand.
 

Services

3.      Nannies on Demand acts as an introduction agency only.  Candidates are not employees of Nannies on Demand.

4.      It is the responsibility of the Client to accurately and honestly advise the Candidate, of their exact requirements by providing the full details of the work for which the Candidate is needed to carry out.  Nannies on Demand will provide to the Client, a Job Description married to the information provided by the Client. 

5       The introduction of a Candidate to a Client by Nannies on Demand, directly or indirectly, is confidential and such introductions are made individually.  If the Client or a member of the Client’s staff or any acquaintance or associate of the Client, passes on an introduction to any other person or persons within two years of the Candidate’s introduction to the Client by Nannies on Demand, resulting in the engagement of the Candidate, the Client shall be liable for payment of the full fee in accordance with Nannies on Demand’s Fee Structure.

6.      While Nannies on Demand endeavors to ensure all candidates are well suited and undertakes all vetting and interview procedures in assessing suitability, Nannies on Demand does not guarantee the suitability of any candidate introduced by Nannies on Demand to the Client.  Suitability includes, but is not limited to, a Candidate’s character, honesty, reliability or professional capacity. 

7.      Nannies on Demand accepts no liability for any loss, injury, damage, expense or compensation suffered or incurred of any nature by the Candidate, arising directly or indirectly from an act or omission by any Candidate introduced to the Client by Nannies on Demand.

8.      Nannies on Demand reserves the right to remove  an appointed candidate from a role, in the event of a client not settling  Nannies on Demand's invoices on time.

Fee Structure

9.      A temporary placement through Nannies on Demand is a placement that does not exceed a total of 20 weeks.  Should a candidate be required to work/be placed for a period of more than 20 weeks this is termed as a permanent placement and fees will be charged accordingly.

10.      The Client holds full responsibility for informing Nannies on Demand immediately upon enlisting the Candidate’s services whether the Client intends to engage a Candidate on a permanent or temporary basis for which the relevant fee will be charged.  Should a Client wish to re-employ a fixed term or temporary Candidate, the Client agrees to advise Nannies on Demand and will be charged accordingly.

11.    Upon a Client enlisting the Candidate’s services, Nannies on Demand will provide to the client a contract which must be completed and signed by both parties with a copy being sent to Nannies on Demands head office. 

12.    Should a Client offer employment to a candidate on either a fixed term or permanent basis and then subsequently withdraw from the offer before the candidate has commenced in the role, regardless of whether an employment agreement has been signed, Nannies on Demand will invoice the Client for 25% of the placement fee plus GST. 

13.    In the event of a Client cancelling a nannies employment when on a fixed term temporary placement, within 2 weeks of the commencement date the Client will be liable in paying the candidate directly, 20% of her gross wage as a form of compensation.  This payment is in addition to any outstanding wages due to the Nanny for hours worked.

14.    Should a Client cancel a temporary day by day booking after the childcare professional has been confirmed in the role, the Client will be required to pay the Nanny 50% of her total wage.  This will be passed on to the Candidate as a means of compensation.  Nannies on Demands cancellation fee will also apply.

15.    Should a Client cancel a babysitting booking after the babysitter has been confirmed in the role, the Client will be required to pay Nannies on Demand’s cancellation fee.

16.    Should a candidate not front up to her role on her first day of employment or cancel her appointment in the role before her start date, a full refund will be due to the Client should fees have been received. 

17.    The Client is responsible for paying the Candidate separately with the exception of the client opting to use our administration wage register.  Should any temporary employment of a Candidate introduced (directly or indirectly) by Nannies on Demand be extended or made permanent within 2 years of Nannies on Demand’s introduction of the Candidate to the Client, the Client is required to pay the difference between the original ‘temporary candidate’ fee charged and the actual fee that is due on the new time period of employment.

18.    Nannies on Demand will issue an invoice after the Client has accepted a Candidate through written instruction for employment.  All placement Fees for Nanny services are payable by the Client within 7 days of the invoice being issued. This excludes Au Pair services). Nannies on Demand have the right to apply a penalty interest of 22% to all over due accounts.  Nannies on Demand also have the right to refer all unpaid accounts to a collection agency, where additional costs could be incurred, which are then deemed the responsibility of the client (‘You’).


Nannies on Demand provides a 12 week guarantee with all fixed term & permanent nanny placements, with a graduated refund being given if Nannies on Demand cannot find a suitable replacement, as set out in our Terms & Conditions.
